Shah Rukh Khan’s son Aryan Khan applies for bail in Sessions Court in drugs case; hearing on Monday

Shah Rukh Khan’s elder son Aryan Khan, who is in Arthur Road jail after being arrested by NCB in a drug raid, has now applied for bail in Sessions Court. On October 8, Aryan appeared before a metropolitan magistrate’s court for his bail hearing following a 5-day NCB custody. However, the court rejected his bail application stating that they were “not maintainable” before it. The plea was not decided on the merits and facts of the case.
As per latest development, Aryan has now applied for bail in the Sessions Court, the hearing of which is likely to take place on Monday. NCB has also received notice for a say on the bail.
Since the office of the Mumbai city civil and sessions court — where the designated special NDPS court is located – is not working on Saturday, Aryan and the two others are spending the weekend in jail.
On Thursday (October 7), the magistrate’s court had rejected the Narcotics Control Bureau (NCB) plea seeking further custody of Aryan along with five others present on the cruise. It had instead ordered for the eight accused to be sent to the judicial custody, following which the lawyers filed for bail. The six male accused were taken to Arthur Road jail, while the two women accused taken to Byculla women’s jail.
Later, on Friday (October 8), Additional Solicitor General (ASG) Anil Singh started his arguments citing hat the magistrate’s court does not have the power to decide on the bail pleas since the case is exclusively triable before the special NDPS court. The NCB in its reply said that while remanding the accused to judicial custody, the magistrate’s court had also in its order said that the case will be transferred to the special court which has its jurisdiction. ASG Singh said that as per the Act, the bail can only be decided by the special court which will conduct the trial.
It’s left to see what turn does this case takes hereafter. Will Aryan get bail? Only time will tell.
